Suspended License

Driving without a valid license is a crime in South Carolina. Driving with a suspended license is also a crime in South Carolina and is generally a more serious crime. These charges are typically heard in either Magistrate or Municipal, although your case can be before the Court of General Sessions if you are a habitual offender. In addition to these situations, if you are charged with a DUI and refuse to perform a breathalyzer test, your license will be suspended. If you are charged with a DWI and refuse a blood test, your license will be suspended. These suspensions are administrative in nature and may be appealed, first to the Office of Motor Vehicle Hearings and then to the Administrative Law Court.
